V. GENOCIDE

  1. KILLINGS, PHYSICAL DESTRUCTION AND PREVENTION OF BIRTHS (STERILIZATIONS)

  Since 1975 the SRV has enacted continued and sustained policies of human rights violations, which are intended to destroy the Montagnard peoples and further calculated to bring about their physical destruction. These policies result in the death of Montagnard people, the physical destruction of the group and the prevention of Montagnard births. These violations specifically violate ‘The Convention on the Prevention and Punishment of the Crime of Genocide’.  

During French colonialism there were an estimated population of three million Montagnards. Today - estimates indicate as little as half a million may now survive.

  Thus in summary:

  1. The SRV is committing genocide by killing members of the indigenous Montagnard peoples in direct violation of Article II (a). Further and in the alternative;  

  2. The SRV is committing genocide by continuing the combined policies of human rights violations listed in this report which deliberately inflict on Montagnards conditions of life calculated to bring about their physical destruction in direct violation of Article II (c). Further and in the alternative; 

  3. The SRV is committing genocide by imposing measures to prevent births specifically within the Montagnard peoples in direct violation of Article II (d).

  I. Killings - the evidence:

Since 1975 the SRV has killed and executed thousands of Montagnards. Further Montagnard farmers and civilians have been executed by SRV authorities. [See in general Violation 8].    

II. Physical Destruction - the evidence:

  1. Since 1975 the SRV has enacted the Fixed Field/Fixed Residence policy [See Violations 3 and 4 for more detail]. This forced removals by SRV authorities are often done during crucial harvesting times. This disruption results in Montagnards suffering from starvation and malnutrition.  

  2. The combined human rights violations in this report form an overall policy intended and calculated to bring about the destruction of the Montagnard peoples. The forced relocations, poverty, discrimination, birth control and years of military operations and executions carried out by SRV authorities since 1975 constitute a policy of genocide towards the Montagnard peoples. 

  3. During French colonialism there was an estimated population of three million Montagnards. Today - estimates indicate as little as half a million may now survive.  

III. Prevention of Births (Sterilizations)– the evidence:

  1. The SRV authorities specifically targets Montagnard communities for birth control and sterilization. While it is difficult to identify the exact number of sterilizations it is certain thousands have been subject to this procedure. Montagnard exiles have complied lists of some of these sterilizations, some of which result in immediate deaths of Montagnard women.   (See the report of genocide) 

  2. The SRV authorities promotes sterilization by paying Montagnard men and women 100,000 dong (less than $10 dollars US) to undergo such sterilization procedures. These Montagnards are poor and in desperation for money and are coerced to undertake this surgery where many of them die. 

  3. SRV authorities distribute birth control pills throughout Montagnard communities on a ongoing basis. Montagnards from within Vietnam report this is current practice.

Remedial measures:

These above violations namely; the killing of Montagnards, the enacted policies intended to bring about the destruction of the Montagnards and measures enacted to prevent Montagnard births are crimes of genocide.  

Further the combined human rights violations in this report have been continued and sustained since 1975. These violations constitute a policy of genocide calculated to bring about the destruction of the Montagnard peoples. 

We the Montagnard peoples request that action be taken immediately by the international community to prevent these genocidal practices which are in direct violation of the Convention for the Prevention and Punishment of the Crime of Genocide.
